Welcome to JustParkHere. These Terms of Sale ("Terms") govern your use of our platform, website, and services that connect parking spot owners with drivers looking for parking. By using JustParkHere, you agree to comply with and be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you may not use our services.

2. Definitions

Throughout these Terms, the following definitions apply:

• "JustParkHere," "we," "us," or "our" refers to the JustParkHere platform and service.
• "User," "you," or "your" refers to individuals who use our service as either parking spot owners or drivers.
• "Parking Spot Owner" refers to users who list their parking spots for rent on our platform.
• "Driver" refers to users who book and pay for parking spots through our platform.
• "Platform" refers to the JustParkHere website and mobile application.
• "Booking" refers to the reservation of a parking spot by a Driver.
• "QR Code" refers to the unique QR code associated with each parking spot that enables booking.

3. Acceptance of Terms

By accessing or using JustParkHere, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

4. User Registration

To use our services, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you confirm that:

• All registration information you submit is truthful and accurate.
• You will maintain the accuracy of this information.
• Your use of our services does not violate any applicable laws or regulations.

5. Parking Spot Listings

For Parking Spot Owners:

• You must have the legal right to list and rent out the parking spot.
• You must provide accurate and complete information about the parking spot, including location, size, accessibility, and any restrictions.
• You are responsible for setting your own pricing, subject to our platform's minimum and maximum limits.
• You must ensure the parking spot is available during the times you indicate.
• You must maintain the parking spot in a safe and accessible condition.
• We reserve the right to remove any listing that violates these Terms or our guidelines.

6. Booking Process

For Drivers:

• You must scan the QR code at the parking spot location to initiate a booking.
• By completing a booking, you agree to pay the specified fee and comply with any restrictions or requirements for the parking spot.
• You must use the parking spot only for the agreed-upon purpose of parking a vehicle.
• You must comply with all applicable laws and regulations while using the parking spot.
• Bookings are subject to availability and cannot be guaranteed until completed through our Platform.

7. Payment Terms

Payment processing on our Platform is secured and managed by our authorized payment processors.

• All payments must be made through our Platform.
• The total price for a parking spot booking will be displayed before you confirm your reservation.
• Prices are inclusive of applicable taxes and our service fee.
• Payments are processed immediately upon booking confirmation.
• For Parking Spot Owners, payment will be transferred to your account after deducting our service fee.
• We reserve the right to withhold payment in case of suspected fraudulent activity or violations of these Terms.

8. Cancellation Policy

Our cancellation policy is designed to be fair to both Drivers and Parking Spot Owners:

• For Drivers:
  • Cancellations made more than 24 hours before the booking start time will receive a full refund.
  • Cancellations made less than 24 hours before the booking start time will receive a 50% refund.
  • No-shows will not receive a refund.
• For Parking Spot Owners:
  • If you need to cancel a confirmed booking, you must do so at least 48 hours in advance.
  • Frequent cancellations may result in penalties or removal from our Platform.
• JustParkHere reserves the right to override this policy in exceptional circumstances.

9. Limitation of Liability

JustParkHere is a platform that connects Parking Spot Owners with Drivers. We do not own, control, or manage any parking spots listed on our Platform.

• We are not responsible for the condition, safety, or legality of parking spots listed on our Platform.
• We are not responsible for damages to vehicles or property that occur during the use of a parking spot.
• Our liability is limited to the amount paid for the specific booking in question.
• In no event shall we be liable for any indirect, special, incidental, or consequential damages.

10. Dispute Resolution

In the event of a dispute between a Parking Spot Owner and a Driver:

• Both parties should first attempt to resolve the dispute amicably between themselves.
• If a resolution cannot be reached, either party may contact our customer support team.
• We will review the evidence provided by both parties and make a decision based on our policies.
• Our decision is final in matters related to refunds and fee adjustments.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Platform. Your continued use of our services after any modifications indicates your acceptance of the updated Terms.

We will notify users of significant changes to these Terms via email or through a notification on our Platform.
